Terms of Service
Effective October 1, 2026.
These Terms govern your use of Posium, including posium.io, posium.events, organizer sites hosted on Posium, and any custom domain an organizer points at Posium (together, the "Service"). The Service is operated by Kelly Copley ("Posium", "we", "us"), in Pennsylvania, USA.
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
If you run events on Posium as an organizer, the Organizer Agreement also applies to you. If the two conflict on a question about organizing events, the Organizer Agreement controls.
1. What Posium is
Posium is software that conference and event organizers ("Organizers") use to sell tickets, run calls for proposals, run contests, collect surveys and host community profiles. Each event on Posium belongs to its Organizer.
Posium is not the organizer of any event and is not the seller of any ticket. When you buy a ticket, register, submit a proposal, enter a contest or answer a survey, you are dealing with the Organizer. The Organizer decides the event's content, dates, eligibility, prices, refunds, judging and code of conduct, and is responsible for them. Payments go to the Organizer's own payment account with Stripe or PayPal. Posium is not a party to that transaction.
2. Eligibility and accounts
- You must be at least 16 years old to create an account. An Organizer may admit younger people to its own event, and is responsible for doing so lawfully, including obtaining any parental consent.
- You must give accurate information and keep it current. You are responsible for activity under your account and for keeping your password secure. Tell us at [email protected] if you believe your account has been compromised.
- One person per account. You may not create an account for someone else without their permission.
3. Organizer terms
Each Organizer may set its own terms for its events: a refund policy, event agreements (such as waivers or a code of conduct), contest rules, submission guidelines and a privacy notice. You will be shown these where they apply. They are agreements between you and the Organizer. Questions about refunds, event changes or cancellations, judging decisions, and your data held by the Organizer go to the Organizer.
4. Payments
- Ticket prices, fees and taxes are shown before you pay. A platform fee may be added at checkout if the Organizer passes Posium's fee on to attendees.
- Card and PayPal details are entered directly with Stripe or PayPal. Posium does not receive or store your full card number.
- Refunds are governed by the Organizer's refund policy and issued by the Organizer. When an Organizer refunds a ticket, Posium's platform fee on that ticket is refunded in full. The payment processor's own fee may not be refunded; that depends on the Organizer's policy.
- If an event is cancelled or an Organizer stops operating, the Organizer is responsible for refunds. Posium will make reasonable efforts to help you contact the Organizer, but does not guarantee refunds.
5. Your content
"Your content" means what you submit to the Service: profile details, bios, headshots and avatars, proposals and abstracts, contest entries and manuscripts, survey answers, and anything else you upload or type in.
- You keep ownership of your content. Posium claims no ownership of it.
- You grant Posium a non-exclusive, worldwide, royalty-free licence to host, store, copy, process, transmit and display your content only as needed to operate the Service for you and for the Organizers you submit it to, including making it visible to the people you or the Organizer choose. This licence ends when your content is deleted from the Service, except for copies kept in backups until they expire and records we must keep under the Privacy Policy.
- Organizers' rights come from the Organizer, not from these Terms. If an Organizer wants to publish an accepted talk, record a session or print a contest winner, the rights to do that are between you and the Organizer, under their submission terms or rules.
- You confirm that you have the rights needed to submit your content, and that it does not infringe anyone else's rights or break the law.
6. Acceptable use
You may not use the Service to:
- break any law, or help anyone else do so;
- run a fraudulent event or sell tickets to an event you do not intend to hold;
- infringe copyright, trademark or other rights, including submitting work you did not write as your own;
- harass, threaten, defame or impersonate anyone;
- send spam or unsolicited messages to attendees or other users;
- upload malware, or attempt to access accounts, data or systems you are not authorised to access;
- probe, scan or load-test the Service, or scrape it by automated means, without our written permission;
- misuse the payment flow, including card testing, chargeback fraud or evading platform fees.
We may remove content or suspend or close an account that breaks these rules, or when required by law. Where practical and lawful we will tell you why.
7. Copyright complaints
If you believe content on the Service infringes your copyright, email [email protected] with: the work you say is infringed; where the content is on the Service (the URL); your contact details; a statement that you believe in good faith the use is not authorised; and a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorised to act for the owner, with your physical or electronic signature. We will respond under the Digital Millennium Copyright Act.
[Attorney: registering a DMCA designated agent with the US Copyright Office is required for the safe harbour. See review notes.]
8. Posium's service
- We work to keep the Service available and secure, but it is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
- We do not warrant that the Service will be uninterrupted or error-free, or that any event will take place as advertised.
- We may change or discontinue features. If we discontinue the Service entirely, we will give reasonable notice where practical.
9. Limitation of liability
To the extent the law allows:
- Posium is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill.
- Posium is not liable for the acts or omissions of Organizers, including event cancellations, changes, refunds, judging decisions or their handling of your data.
- Posium's total liability to you for all claims relating to the Service is limited to the greater of (a) the platform fees Posium received on your purchases in the 12 months before the claim arose, and (b) US $100.
Some jurisdictions do not allow these limits, so they may not all apply to you.
10. Indemnity
If you use the Service in breach of these Terms or the law, and a third party makes a claim against Posium as a result, you agree to cover Posium's reasonable losses and costs from that claim.
11. Ending your use
You can stop using the Service at any time and request deletion of your account under the Privacy Policy. We may suspend or close your account under section 6. Sections 4 (as to completed purchases), 5 (as to your warranties), and 8 to 13 survive.
12. Changes to these Terms
When we make a material change, we will email account holders at least 30 days before it takes effect, and ask you to accept the new version the next time you use the Service after that date. Minor changes (corrections, clarifications, or changes that do not reduce your rights) are published here with an updated effective date. Past versions are available on request.
13. Law, disputes and general terms
- These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules.
- Any dispute will be brought in the state or federal courts located in Tioga County, Pennsylvania, and you and Posium consent to their jurisdiction. Either party may bring a qualifying claim in small-claims court instead.
- Posium may assign these Terms to a successor, including a company formed to operate the Service, and will tell you if it does. You may not assign them without our consent.
- If part of these Terms is unenforceable, the rest stays in effect. Our not enforcing a term is not a waiver of it.
- These Terms, the Privacy Policy and, for Organizers, the Organizer Agreement are the whole agreement between you and Posium about the Service.
